These Terms of Use govern your use of the Next Team Talent LLC (“Next Team Talent,” “we,” “us”) website at nextteamtalent.com and our online candidate assessments. Please read them carefully.
1. Acceptance of these terms
By using our website or completing one of our candidate assessments, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the website or assessments. You must be at least 18 years old to submit information through our website or complete an assessment.
2. Separate client agreements
These website terms are separate from any client services agreement. Paid recruiting, leadership development and consulting engagements are governed by a separate written agreement between Next Team Talent and the client. If a client services agreement conflicts with these terms, the client services agreement controls for that engagement.
3. Permitted and prohibited use
You may use our website for lawful purposes: to learn about our services, contact us, schedule a consultation, or complete an assessment you have been invited to take. You agree not to:
- Use the website in a way that violates any law or the rights of others
- Submit false, misleading or someone else's information
- Attempt to gain unauthorized access to our website, private workspace, systems or data, or interfere with their security or operation
- Use automated tools to scrape, copy or collect content or data from the website
- Copy, share, publish or distribute assessment questions, links or content
- Upload or transmit malicious code, spam or harmful content
4. Ownership of content
The website and its content belong to Next Team Talent or its licensors. That includes text, graphics, logos, page design, and our assessments, their questions and scoring methods, and our hiring tools and templates. They are protected by intellectual property laws. You may view and print pages for your own personal or internal business reference. You may not copy, modify, distribute or create derivative works from our content without our written permission. Materials provided to clients as part of a paid engagement are governed by the applicable client services agreement.
5. Information you submit
You agree that information you submit through our website or assessments will be accurate, current and your own. We may rely on that information when responding to you or providing our services. We handle personal information as described in our Privacy Policy.
6. Candidate assessments
Our candidate assessments are provided to selected candidates as part of specific recruiting engagements. If you complete an assessment, you agree to:
- Complete it yourself and answer honestly, based on how you would actually approach the work
- Keep the assessment link and content confidential and not share them with others
Your responses are personally reviewed by our team. Relevant results may be shared with the employer associated with the opportunity, as described in our Privacy Policy. Completing an assessment is voluntary.
7. No guarantee of employment or outcomes
Completing an assessment, submitting information or communicating with us does not guarantee an interview, a job offer, employment or any other outcome. Hiring decisions are made solely by employers. We do not guarantee any particular result from our services, including a hire or a candidate's performance.
8. Inquiries do not create a client relationship
Submitting an inquiry, scheduling a consultation or communicating with us does not create a client relationship or obligate either party to an engagement. A client relationship begins only when both parties sign a client services agreement.
9. Third-party websites and services
Our website may link to or rely on third-party websites and services, such as our consultation booking page. We do not control and are not responsible for their content, policies or practices. Your use of them is governed by their own terms.
10. Disclaimers
To the fullest extent permitted by law, the website and assessments are provided “as is” and “as available,” without warranties of any kind, whether express or implied. That includes implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the website will be uninterrupted, error-free or free of harmful components. Website content is for general information only and is not legal, financial, employment or other professional advice.
11. Limitation of liability
To the fullest extent permitted by law, Next Team Talent LLC and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or business opportunities, arising from or related to your use of the website or assessments. Our total liability for any claim arising from or related to the website or assessments will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Nothing in these terms limits liability that cannot be limited under applicable law.
This Section 11, including the $100 limit, applies only to your use of the website and online assessments. It does not apply to, limit or govern any paid recruiting, leadership development or consulting engagement. Those engagements are governed exclusively by the applicable client services agreement.
12. Governing law
These terms are governed by the laws of the State of Minnesota, without regard to its conflict of laws rules, and subject to any mandatory protections of the law where you live. Any dispute arising from these terms or your use of the website will be brought in the state or federal courts located in Minnesota, unless applicable law requires otherwise.
13. Changes to these terms
We may update these Terms of Use from time to time. We will post the updated version on this page with a new effective date. Your continued use of the website after an update means you accept the revised terms.
